Terms of sale and payment
Last updated: 29 October 2026
Purpose
These terms govern the use of the 440hz.fr website and the online payment of 440Hz SAS invoices. Telephony services and equipment are supplied under the terms of the quote or contract signed with the customer, which prevail in case of conflict.
Customers
The offers of 440Hz SAS are intended exclusively for business customers (companies, public bodies, resellers) acting for the purposes of their business.
Prices
Prices are in euros, excluding VAT; applicable VAT (currently 20%) is added. The summary shown before payment states the amount excluding VAT, the VAT and the total including VAT to be paid.
Online invoice payment
Payment is made by bank card (Visa, Mastercard, CB) through our payment provider Stripe Payments Europe, Ltd. The customer enters the cardholder name, the amount including VAT and, where applicable, the relevant invoice number(s) (separated by a comma). Payment is taken into account only after authorisation by the issuing bank and confirmation on screen.
Card data is entered and processed by the payment provider; 440Hz SAS has no access to it.
Late payment
Any sum unpaid at its due date automatically bears late-payment interest at the rate stated in the contract or on the invoice (at least three times the legal interest rate), plus a fixed recovery indemnity of €40 (articles L.441-10 and D.441-5 of the French Commercial Code).
Right of withdrawal
The 14-day right of withdrawal under the French Consumer Code does not apply to business customers acting for the purposes of their business. Paying an existing invoice does not create a new contract.
Mediation
As the offers are reserved for businesses, consumer mediation does not normally apply. Should a consumer contract with 440Hz SAS, they may use the following mediator free of charge: the Electronic Communications Mediator (Médiation Télécom), online at https://www.mediation-telecom.org/saisir-le-mediateur.
Site availability
The site is available subject to interruptions for maintenance or force majeure. 440Hz SAS cannot be held liable for damage resulting from temporary unavailability of the site.
Personal data
Data processing is described in the privacy policy.
Governing law and disputes
These terms are governed by French law. In case of dispute, the parties will seek an amicable solution; failing that, the Nanterre Commercial Court has jurisdiction, unless mandatory law provides otherwise.
